HC stays DC order cancelling licence of WWICS

CHANDIGARH: The Punjab and Haryana high court on Friday stayed the order passed by deputy commissioner (DC) Mohali cancelling the licence of immigration consultants WWICS.

In her order, passed on Thursday, Mohali DC Gurpreet Kaur held that there were anomalies in the registration process. The company was issued many notices and failed to provide verified documents to validate its claim, she had said in her order.

Challenging the orders, the company had filed an application before the Punjab and Haryana high court. Hearing the application, a division bench comprising Justice Mahesh Grover and Justice Raj Shekhar Attri stayed the DC's order. It also expressed its displeasure on the passing of the order even though the authorities had been restrained from doing so. 

The bench observed that court had been seized of the matter and on November 30, in the presence of the counsel representing the state and other respondents, had restrained the competent authority from passing final order. Yet, an order was said to have been passed on the same day, cancelling the licence of the applicant, observed the bench in its orders.

The bench was also of the view that the restrain order was passed in the presence of the counsel for the parties and it was expected that the order ought to have been communicated to the competent authority.
